1. Agreement to Terms

By accessing or using Sweet Her AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Sweet Her AI is operated by Sweet Her AI, a sole trader registered in Australia ("we", "us", "our"). Our Service provides AI-generated character conversations accessible via messaging platforms.

2. Eligibility

You must be at least 18 years of age to use this Service. By using Sweet Her AI, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We reserve the right to request proof of age at any time and to suspend or terminate accounts that do not meet this requirement.

3. Description of Service

Sweet Her AI provides AI-generated character conversations through messaging platforms. Our characters are fictional AI personas, each with their own personality, backstory, and conversation style. All content generated by the Service is created by artificial intelligence and does not represent real people.

The Service may include free and premium tiers. Features, pricing, and availability may change at our discretion with reasonable notice.

4. User Accounts

Access to the Service is provided through third-party messaging platforms. You are responsible for maintaining the security of your messaging platform account. You agree not to share your account access with others or use the Service on behalf of another person.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models or technology
  • Use automated tools, bots, or scripts to interact with the Service (beyond normal messaging platform use)
  • Attempt to circumvent usage limits, payment requirements, or access controls
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Harass, abuse, or threaten others through the Service
  • Use the Service to generate content that exploits minors in any way
  • Redistribute, republish, or commercially exploit content generated by the Service without written permission

We reserve the right to suspend or terminate your access at any time if we determine, in our sole discretion, that you have violated these Terms.

6. Payments and Subscriptions

Premium features are available through paid subscriptions and virtual goods purchases. Payments are processed through Stripe and/or the Telegram Stars platform.

  • Subscription fees are billed in advance on a recurring basis (weekly, monthly, or quarterly, depending on the plan selected).
  • Subscriptions automatically renew unless cancelled before the end of the current billing period.
  • Prices are displayed in USD and may be subject to applicable taxes.
  • We reserve the right to change pricing with at least 14 days' notice. Existing subscribers will be notified before any price change takes effect on their account.

7. Virtual Goods

The Service may offer virtual goods, including but not limited to in-app currency, virtual gifts, and premium content. Virtual goods are digital content licensed to you for personal, non-transferable use within the Service. They are not redeemable for monetary value and cannot be exchanged, sold, or transferred outside the Service.

Purchases of virtual goods are final and generally non-refundable, except as required by applicable law or as described in our Refund Policy.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, characters, character designs, logos, and software — are owned by Sweet Her AI or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the messages you send to the Service. By using the Service, you grant us a limited license to process your messages for the purpose of generating AI responses and improving the Service. We do not claim ownership of your messages.

9. AI-Generated Content

All character responses are generated by artificial intelligence. While we strive to make conversations enjoyable and engaging, AI-generated content may occasionally be inaccurate, inappropriate, or unexpected. The Service is provided for entertainment purposes. AI-generated responses should not be relied upon for professional, medical, legal, financial, or other advice.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by Australian law, Sweet Her AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your data

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination shall remain in effect.

You may stop using the Service at any time. If you have an active subscription, you may cancel it through the payment platform used for your subscription.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the Service or by other reasonable means. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Australia. Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law that cannot be excluded, restricted, or modified.
